We welcome you as a Member of The Arc Circle. The Arc Circle is a service offered by JI Lifestyle GmbH, Thomas-Dehler-Str. 2, 81737 München, AG München: HRB 228594 (hereinafter “The Arc Circle”).
The following terms and conditions exclusively apply to your membership in The Arc Circle. When you book The Arc Circle Offers special terms and conditions of the relevant provider will apply. The provider is your contract partner in such cases and such terms and conditions will be made available to you separately.
1. Membership.
Only selected individuals, couples and others are admitted to membership in The Arc Circle. Your membership is therefore personal and not transferrable.
Your membership commences when you have paid your membership fee and is concluded for a fixed period of 1 year. Your membership automatically renews for a duration of 1 year if it is not cancelled in writing by you at least 3 months before the contract would otherwise automatically be renewed.
When you become a member of The Arc Circle you will not acquire shares or any other position in JI Lifestyle GmbH, and will only receive the right to use the below services.
2. Services of The Arc Circle.
As a member of The Arc Circle you are entitled to many benefits, services and offers:

· Access to leading therapists, coaches and experts;
· One-on-one online talks with the leading global names in health;

· Free ‘money-can’t-buy’ bespoke Arc Welcome Experience
· Access to the first and only global 360° health, wellness and better ageing concierge service and virtual membership club; Use of The Arc Circle Concierge Services including access to The Arc Circle Online Portal; Regular printed and digital communications regarding the further offers of The Arc Circle; The possibility to conclude individual contracts about services offered by The Arc Circle and/or by our partners.
PLEASE NOTE: Members enjoy access to all the above benefits, services and offers, but are required to pay for all other services, products and experiences booked.
The services of The Arc Circle are offered to you by The Arc Circle, by our official partner Healing Holidays, and/or by other third parties. You are completely free to choose which of the services offered you want to use, and you book those services on your own responsibility. When you book Services you enter into a separate contract with the respective service provider and the applicable terms and conditions of your contract partners apply. All terms and conditions will be communicated to you separately via The Arc Circle Concierge Service or The Arc Circle Online Portal. Up until a contract is concluded, all offers as part of The Arc Circle Services are subject to change. Offers are subject to availability and considered according to the order in which they are received (“first-come, first-served” principle).
The Arc Circle offers cannot be combined with other offers, discounts or promotions from the respective provider or third parties. You cannot transfer or pass on any entitlement to the Services of The Arc Circle to third parties.
The Arc Circle will always strive to provide a regular programme of Services and third-party services, which is as diverse and broad as possible; however, as a member, you are not entitled to a certain minimum number or scope of offers or a certain type, form, or quality of offer. In addition to these GTCs, the conditions and reservations published with these offers shall apply to said offers, as already explained above.
In cases of force majeure, such as in particular natural and other disasters, fire damage and epidemics (including epidemics and pandemics) and insofar as a level of risk has been determined by public authorities which does not allow the possibility of using the membership for reasons of force majeure for a period of at least two weeks, for the proof of which the member is responsible, the membership shall be automatically extended by this period. The Member shall In cases of force majeure, there shall be no rights to reclaim the membership fee or parts thereof.
3. The Arc Circle Membership registration and expiry.
You will receive from us your personal confirmation and details of your The Arc Circle Membership .
Our The Arc Concierge Service will assist you with regard to all questions on your membership, data and other information regarding the use Services.
Please make sure to store your access data for The Arc Circle Online Portal safely and keep it protected against third-party access. If you suspect that any third party has gained knowledge of the access data or had / has access to your The Arc Circle Online Portal log-in, please ensure to report this immediately to us by email to service@thearccircle.com or to The Arc Circle Concierge Hotline. We will then block and support you to update your log-in to The Arc Circle Online Portal.
You can deactivate your membership registration at any time, e.g. by giving notice by email, telefax or via The Arc Circle Concierge Hotline, but naturally only with effect to the end of the membership period. Of course, you can always terminate your membership for cause under statutory law. In the case of a couple membership, either member may give notice of termination with effect for the other. You can also deactivate your subscription of the regular The Arc Circle publications. In such cases you will not be entitled to compensation or refunds in the event of a deactivation or limitation of services. But a reactivation of your membership is possible at any time up until expiry of the membership period paid for. Likewise, a reactivation of receipt of the publication and further information about The Arc Circle is possible at any time up until expiry of the respective period.
Withdrawal Notice
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us at JI Lifestyle GmbH, Thomas-Dehler-Str. 2, 81737, Munich. Phone number: +49 89 6427 97-0, Fax number: +49 89 6427 97-77, e-mail: service@thearccircle.com by means of a clear notification (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but it is not mandatory. You can also fill out and submit the model withdrawal form or another clear notification electronically on our website www.thearccircle.com. If you make use of this option, we will send you confirmation of receipt of such revocation without delay (e.g. by e-mail).
In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercising of the right of withdrawal before the end of the withdrawal period.
Consequences of the revocation
If you withdraw from this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. If you have requested that the services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you notify us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.

4. Blocking of services and exclusion from membership.
In the unlikely event that a member commits a serious violation of the conditions of membership or the contractual provisions relating to a Service, The Arc Circle and / or the respective contractual partner reserve the right to refuse providing further Services to such member and to exclude this member from receiving further services of The ARC Circle and from using the Online Portal.
5. Changes to the conditions of membership.
The world keeps turning and it may become necessary to adapt your terms and conditions for the membership in The Arc Circle. Therefore, The Arc Circle reserves the right to make changes or additions to these conditions of membership of The Arc Circle at any time. This applies only if and to the extent that such changes do not put you as a member at an unreasonable disadvantage that is contrary to good faith. You can always find the latest version of The Arc Circle Terms and Conditions of Membership are available on The Arc Circle Online Portal or via The Arc Circle Concierge Service.
In case of changes or additions to the conditions of membership we will inform you in writing (e.g. by email) at least one month before such changes of additions enter into effect. Members may object to them in writing within 10 working days after receipt of the notification.

7. Liability.
The Arc Circle excludes all liability for damages to the member, unless stated otherwise in the following. Excluded from this exclusion of liability are both the liability for damages resulting from injury to life, body or health, if such damages are due to a negligent breach of duty on the part of The Arc Circle, and the liability for other damages, if such damages are due to an intentional or grossly negligent breach of duty or the minor negligent breach of essential contractual obligations on the part of The Arc Circle. Essential contractual obligations are those whose fulfilment is necessary to achieve the purpose of the contract and on whose compliance the member may rely. The Arc Circle expressly excludes all liability for loss of profit, goodwill or contracts and for any indirect, consequential or economic loss.
8. Information on data processing and use.
Use of the member’s general personal data.
The Arc Circle and the providers of the respective services store membership and contract data as well as other data provided by the member for the provision of the Services. The stored data may be transferred to contractual partners of The Arc Circle provided that this is necessary for completing the contractually agreed services (e.g. data regarding bookings). Changes to personal details can be made online or via The Arc Circle Concierge Hotline.
9. Other provisions.
Choice of law and Place of Jurisdiction.
The laws of the Federal Republic of Germany apply exclusively and with the exclusion of the provisions on conflict of laws. Regardless of this provision on choice of governing law, consumers who are normally resident in the EU in a country other than the Federal Republic of Germany may always invoke the laws of the EU-state in which they are resident. If the member is a merchant, then the exclusive (and international) court of jurisdiction for all disputes resulting directly or indirectly from the contractual relationship is Munich. In the case of cross-border contracts, this also applies for non-merchants.

JI Lifestyle GmbH does neither commit itself nor is obliged to use alternative dispute resolution entities to resolve disputes with consumers.
